The Disciplinary Policy and Procedures was updated in line with best practice and now includes more detail.
The Disciplinary Policy and Procedures have been previously amended to highlight discriminatory criteria, including the 1st October 2006 regulatory changes in respect of age discrimination.
All businesses are required to provide written Disciplinary Rules and Procedures. This requirement has been in force since October 2004 with application of the Employment Act 2002 (Dispute Resolution) Regulations 2004. All employers must have in place minimum statutory procedures to encourage resolution of dismissal, disciplinary and grievance disputes in the workplace, and to notify their employees of these procedures.
Until October 2004 there was no legal requirement to have written disciplinary and grievance procedures in place for businesses with fewer than 20 employees. All employers and employees are now required to comply, irrespective of the size and administrative resources of the organisation.
Please note that from the 6th April 2009 a new ACAS Code of Practice applies and it replaces the Statutory Dispute Resolution Procedures. Therefore, this document should only be applied where the dismissal or disciplinary action occurred on or before the 5th April 2009. However, the new ACAS Code of Practice does not apply to the non-renewal of Fixed Term Contracts on their expiry; therefore, this document should be used where dismissals are due to the non-renewal of Fixed Term Employment Agreements since the Statutory Dispute Resolution Procedures still apply in these circumstances.
