Letter Terminating a Periodic Tenancy

This Letter Terminating a Periodic Tenancy gives the Tenant formal notice that his periodic assured shorthold tenancy will be terminated. This Letter and the notice contained in it comply with section 21(4) of the Housing Act 1988.

An assured shorthold tenant is allowed to remain in occupation of the property after the end of the fixed term of his tenancy. The tenancy becomes a “periodic” assured shorthold tenancy. If the Landlord requires the Tenant to vacate, he must serve an appropriate notice on the Tenant. Recovering possession of property is easier for the Landlord of an assured shorthold tenant, as opposed to an assured tenant, because the Landlord does not need to show any fault on the part of the Tenant.

Please note that this Letter is only suitable for assured shorthold tenancies. It cannot be used to terminate any other types of tenancy. Consider using the Section 8 Notice Seeking Possession or the Notice to Quit instead.

This Letter must only be used in respect of a periodic assured shorthold tenancy. If the Landlord wishes to serve notice during the fixed term so that the tenancy expires at the end of, or shortly after the end of, the fixed term, he should use the Letter Terminating a Tenancy at the end of the Fixed Term.

The termination date specified must be at least 2 months after the Letter is received by the Tenant and it must fall on the last day of a period of the tenancy. For example, if rent is payable on the 3rd day of each month, the last day of the period is the 2nd day of any month.

Sending this Letter is in effect the first step in the accelerated repossession procedure for properties let on assured shorthold tenancies. If the court is satisfied that a valid section 21(4) notice has been served, it will order the Tenant to vacate the property.

The Landlord should enclose with this Letter the Letter regarding Termination Arrangements. That letter reminds the Tenant of the steps he must take before vacating the property.

The Letter requests the Tenant to sign a copy of the Letter and return it to the Landlord to confirm receipt. The Landlord must remember to send the Tenant two copies of the Letter and a stamped addressed envelope.

The Letter should be delivered by hand or sent by recorded delivery. Remember that the 2 month notice period begins from the time the Tenant receives the Letter, not when the Letter was posted. Always allow a few extra days when setting the termination date. For example, if the Letter is sent by recorded delivery on 25 June, do not give a termination date of 25 August. Instead, select a later date such as 28 August (or such later date as is the end of a period of the tenancy).
