Document Description
This Annualised Hours Employment Contract allows for a total number of hours to be agreed between Employer and Employee, which are then worked in variable quantities over the year.

This Annualised Hours Employment Contract has been updated to comply with the changes introduced on 1st April 2009, particularly, concerning the increase in the statutory holiday entitlement and payment in lieu of holiday. From 1st April 2009 statutory holiday entitlement increases to 28 days from 24 days, including public and bank holidays.

In relation to payment in lieu of holiday, from 1st April 2009 it is no longer possible to pay employees in lieu of them taking their full statutory holiday entitlement. However, payment in lieu of holiday above the statutory entitlement is allowed and a new clause has been included in the contract to reflect the change.

This contract is particularly suited to industries that have peaks and troughs of demand, and can be a way of getting around the need for overtime. Although this type of arrangement can give rise to concerns about health and safety, a requirement remains in Europe to adhere to the Working Time Directive. This was implemented in England and Wales by the Working Time Regulations 1998 which provide for a maximum 48 hour working week and mandatory rest periods.

It is possible to opt out of the Directive by agreement between Employer and Employee. For more detail please refer to the Working Time Directive Waiver.

Annualised Hours agreements provide many employees with the ability to achieve a more desirable work – life balance and to have more control over their time.

Annualised Hours Contracts can work well with part time arrangements and may also be scheduled in order to achieve term time working which is ideal for working parents.
